Appellant

Angela Pliemling appealed her felony conviction for unlawful receipt of public assistance benefits. She was charged and convicted under a statute, Section 578.377 RSMo., that had been repealed and replaced by Section 570.400 RSMo. before the alleged acts occurred. The appellate court found that the trial court committed plain error resulting in manifest injustice by convicting Pliemling under an abrogated statute and by instructing the jury on an incorrect value threshold for felony classification. The court reversed the judgment and remanded the case with instructions to dismiss unless the state files an amended information under the correct statute.
