Plaintiff Wayne Morelock sued Burrito Concepts, LLC, to recover a debt, and Burrito Concepts filed a counterclaim for a debt owed by Morelock. The trial court entered judgment for Morelock on one count and for Burrito Concepts on its counterclaim. On appeal, Morelock challenged the counterclaim judgment, arguing it was barred by the five-year statute of limitation. The appellate court affirmed the judgment in favor of Morelock, reversed the judgment in favor of Burrito Concepts, and remanded with instructions to enter an amended judgment solely for Morelock, finding the counterclaim was time-barred.
