Missouri Court of Appeals, Western District / Dec 26, 2018
State of Missouri vs. Caroline Lazinger
Caroline Lazinger appealed her conviction for two counts of aggravated stalking, arguing insufficient evidence of purposeful harassment and improper admission of testimony regarding victims' subjective feelings. The appellate court affirmed the judgment. It found sufficient evidence that Lazinger purposely harassed M.L. through an intermediary by contacting their son, S.L., despite a protection order. The court also held that testimony about the victims' prior subjective fear was relevant to the objective "reasonable person" standard for harassment in the later incidents.
