Missouri Court of Appeals, Southern District / Nov 4, 2019
STATE OF MISSOURI, Plaintiff-Respondent v. DAVID HOWARD ABEL, Defendant-Appellant
David Abel was convicted of neglect of a child after his ten-month-old son died of hyperthermia when left in a car on a hot afternoon. On appeal, Abel contended the evidence failed to establish beyond a reasonable doubt that he acted knowingly. The appellate court affirmed the trial court's judgment, finding that the State presented sufficient evidence from which a reasonable fact-finder could have found the knowledge element of the crime.
