Missouri Court of Appeals, Southern District / Sep 22, 2023
STATE OF MISSOURI, Respondent v. DESMOND TYEZ GREER, Appellant
Desmond Tyez Greer, a convicted felon, appealed his conviction for unlawful possession of a firearm after a handgun was found under the driver's seat of a vehicle he was operating. He argued there was insufficient evidence to prove he consciously and intentionally possessed the firearm and that the trial court plainly erred by conducting his sentencing hearing virtually without his physical presence. The appellate court affirmed the judgment, finding sufficient circumstantial evidence to support the possession conviction and declining plain error review for the virtual hearing issue as Greer failed to show outcome-determinative error.
