Missouri Court of Appeals, Western District / Nov 30, 2021

Elizabeth Ann Janet vs. Robert Michael Janet

Appellant

Robert Michael Janet (Husband) appealed the judgment dissolving his marriage to Elizabeth Ann Janet (Wife), challenging the maintenance award and the division of marital property. The appellate court affirmed the trial court's finding that Wife was entitled to maintenance and its chosen valuation date for marital assets. However, the court reversed the non-modifiable nature and fixed duration of the maintenance award, as well as the amount exceeding Wife's reasonable needs. The case was remanded for recalculation of marital property values to correct errors regarding a truck and building ownership, and for recalculation of a modifiable, indefinite maintenance award consistent with Wife's reasonable needs.
