Missouri Court of Appeals, Southern District / Jun 27, 2018
STATE OF MISSOURI, Plaintiff-Respondent, v. GREGORY VITABILE, Defendant-Appellant.
Gregory Vitabile was found guilty of operating a motor vehicle without a valid driver's license after a bench trial and appealed. The appellate court dismissed his appeal due to numerous and egregious briefing deficiencies, including a lack of citations to the record, no points relied on, and failure to discuss the interaction of law and facts or state the standard of review. The court held that it could not review the appeal without abandoning its impartial role and acting as the defendant's advocate.
