Erby's amended petition alleged violations of the Missouri Human Rights Act (MHRA) and the Public Employee Whistleblower Statute (PEWS). The circuit court dismissed the claims, finding they abated upon Erby's death because they were not "personal injuries" under the survivorship statute.
