Missouri Court of Appeals, Western District / May 29, 2018
State of Missouri vs. Jacky D. Baker
Jacky D. Baker appealed his sentence following a guilty plea to endangering the welfare of a child, arguing the trial court exceeded its statutory authority by imposing 180 days of "shock time" as a condition of probation. The appellate court reviewed for plain error, finding the issue was not waived by the guilty plea as it concerned a sentence exceeding the statutory maximum. The court concluded that the maximum period of detention for a Class A misdemeanor as a condition of probation is thirty days. Therefore, the court reversed the sentence regarding the length of detention and remanded the case for re-sentencing.
