The Puetz siblings appealed the denial of their motion to set aside a default judgment entered against them in favor of their former law firm, Zick, Voss, Politte & Richardson (ZVPR). ZVPR had obtained the default judgment after the Puetzes failed to file a responsive pleading within 30 days, relying on Rules 55.25(a) and 74.05(a). The appellate court reversed and remanded, holding that these rules do not apply to civil cases originally filed in the Associate Circuit Division, which are governed by Chapter 517 RSMo, and thus the Puetzes were not in default as a matter of law.
