Missouri Court of Appeals, Southern District / Apr 30, 2019
STATE OF MISSOURI, Plaintiff-Respondent vs. JEREMY SCOTT SYKES, Defendant-Appellant
Jeremy Scott Sykes appealed his conviction for second-degree assault, arguing the trial court erred by allowing a highway patrolman to offer expert opinion that Sykes was driving the truck involved in a collision. Sykes contended the expert's opinion was not based on sufficient facts or reliable methods under section 490.065.2, RSMo. The appellate court affirmed the trial court's judgment, concluding that even if the expert testimony was admitted in error, it was not prejudicial because other evidence independently supported the jury's finding that Sykes was the driver.
