Missouri Court of Appeals, Eastern District / Mar 23, 2021
L.M.M., Respondent, v. J.L.G., Appellant.
J.L.G. appealed a full order of protection granted to L.M.M., alleging the judgment was against the weight of the evidence because L.M.M. failed to prove J.L.G.'s actions constituted stalking. L.M.M. accused J.L.G. of frequent texts and contacting her employer, causing L.M.M. to worry J.L.G. would come to her workplace. The appellate court reversed and vacated the order, finding insufficient evidence that L.M.M. subjectively feared physical harm or that a reasonable person would fear physical harm, which are required elements for stalking under the Missouri Adult Abuse Act.
