State of Missouri vs. Johnny D. Floyd
Johnny D. Floyd was convicted by a jury of unlawful use of a weapon, unlawful possession of a firearm, resisting arrest, and first-degree burglary. On appeal, Floyd argued the trial court violated his due process rights by allowing him to represent himself without a proper Faretta hearing and by refusing a self-defense instruction. The appellate court reversed Floyd's convictions and sentences, agreeing with the State's concession that the trial court erred by failing to conduct the requisite Faretta hearing to ensure a knowing, intelligent, and voluntary waiver of counsel. The case was remanded for a new trial.
