Missouri Court of Appeals, Southern District / Dec 18, 2020
STATE OF MISSOURI, Plaintiff-Respondent vs. JOSHUA ROLAND GILLEY, Defendant-Appellant
Joshua Roland Gilley appealed his conviction for the class B felony of assault in the second degree, arguing there was insufficient evidence to support a finding of a "reckless" mental state. Gilley was convicted of striking a booking officer after being arrested. The appellate court affirmed the conviction, concluding that the evidence, including Gilley's background as a mixed martial arts fighter and the force of the blow, was sufficient to establish that he consciously disregarded a substantial and unjustifiable risk of serious physical injury.
