Justin Long was convicted of driving while intoxicated following a bench trial. On appeal, Long challenged the denial of his motions to suppress evidence and statements, arguing that the arresting officer lacked reasonable suspicion for detention, probable cause for arrest, and that the HGN and PBT results were improperly admitted. The Southern District of Missouri affirmed the conviction, finding that the initial encounter was consensual, reasonable suspicion quickly developed, probable cause for arrest existed, and the HGN and PBT evidence were properly admitted.
