Charles Baker and Kathleen Weaver-Baker's marital separation agreement entitled Wife to twenty percent of the net proceeds from Husband's personal injury lawsuit. After receiving an initial payment, Husband obtained a $1,000,000 settlement from an equitable garnishment action related to the same personal injury judgment, but did not share these proceeds with Wife. Husband sought a declaratory judgment, arguing the equitable garnishment settlement was independent and nonmarital property. The trial court granted summary judgment for Wife, and the appellate court affirmed, holding that the equitable garnishment settlement constituted proceeds from the personal injury lawsuit subject to the separation agreement.
