Missouri Court of Appeals, Eastern District / May 18, 2021

Lamont Campbell, Appellant, v. State of Missouri, Respondent.

Appellant

Lamont Campbell appealed the dismissal of his Rule 29.15 motion for post-conviction relief as untimely. The motion court dismissed the motion because it was filed more than six months after the deadline. On appeal, the Eastern District dismissed Campbell's appeal, holding that his notice of appeal was untimely and he failed to request a special order to file a notice of appeal out of time under Rule 30.03, which constitutes a jurisdictional defect.

Missouri Court of Appeals, Eastern District / Aug 21, 2018

State of Missouri, Respondent, vs. Lamont Campbell, Appellant.

Appellant

Lamont Campbell was convicted of first-degree murder and armed criminal action. On appeal, he challenged the trial court's denial of his request to strike a juror for cause, argued his sentence under Section 565.033 was an unconstitutional ex post facto law, and claimed the State failed to disclose exculpatory evidence in violation of Brady. The Eastern District affirmed the judgment, finding the juror issue moot as the juror did not serve, that Section 565.033 did not increase his punishment, and that he was already aware of the evidence allegedly withheld by the State.
