State of Missouri vs. Marcus Simms
Marcus Simms was convicted of first-degree murder, armed criminal action, and first-degree tampering with a motor vehicle. On appeal, Simms argued the trial court abused its discretion by denying his requests for a trial continuance and mistrial, asserting he was incompetent to stand trial, and by allowing the State to repeatedly question him about his attempts to help the murder victim. The Missouri Court of Appeals, Western District, affirmed the convictions, finding substantial evidence supported the trial court's determination of competency and no abuse of discretion in the evidentiary ruling.
