Marquan Dezarsha Townsend appealed his bench-trial conviction for the class-E felony of resisting arrest, arguing there was insufficient evidence that his flight created a substantial risk of serious physical injury or death. The Southern District of Missouri Court of Appeals affirmed the conviction. The court found that the trial court could reasonably conclude Defendant's driving, which included speeding, fishtailing, failing to stop at stop signs in a populated area, and coming within 15 feet of a pedestrian, created such a risk.
