Missouri Court of Appeals, Southern District / Dec 4, 2023
STATE OF MISSOURI, Plaintiff-Respondent v. MICHAEL JACOB SMITH, Defendant-Appellant
Michael Smith was convicted of the class A misdemeanor of resisting a lawful stop following a jury trial. On appeal, Smith challenged the sufficiency of the evidence, arguing the State failed to prove he acted with the purpose of preventing the stop. The appellate court affirmed the conviction, finding ample evidence from which a reasonable juror could infer Smith's purpose to flee, based on his continuous actions while driving and on foot.
