Kayla Williams, a registered nurse, had her license suspended by the Missouri State Board of Nursing after she missed a required drug screen while participating in an intervention program. The trial court reversed the Board's suspension, finding it unlawful, unreasonable, arbitrary, and capricious, and permanently enjoined the Board's order. The Southern District of the Missouri Court of Appeals vacated the trial court's judgment, holding that the trial court misapplied the law by considering mitigating factors not permitted under the relevant statute, section 335.067 RSMo. The appellate court remanded the case with instructions to reinstate the Board's disciplinary order.
