Roger Wayne Sallee was found guilty of driving while intoxicated and sentenced as a chronic offender. On appeal, Sallee challenged the sufficiency of the evidence supporting his chronic offender status and the admission of alleged hearsay testimony. The appellate court affirmed the conviction, finding no error in the admission of the hearsay testimony as it was not offered for the truth of the matter asserted, and concluding there was sufficient evidence for two of the challenged prior intoxication-related traffic offenses to establish chronic offender status.
