Scott Ingalsbe was convicted of two counts of sexual misconduct in the first degree. On appeal, he challenged the sufficiency of the evidence and the legality of his sentences. The appellate court affirmed the convictions, finding sufficient evidence to support the jury's verdict. However, the court reversed the sentences, concluding that the trial court committed plain error by applying a statutory enhancement provision that was not in effect at the time of the offenses, violating ex post facto principles. The case was remanded for resentencing.
