Missouri Court of Appeals, Eastern District / Oct 5, 2021

Adam Luebbering, et al., Appellants, vs. Shimir Varia, et al., Respondents.

Respondent

Adam and Stephanie Luebbering sued Lexicon Relocation, LCC, and others, alleging tort claims related to property disclosures. The trial court dismissed the claims against Lexicon based on a forum selection clause in a Rider to the home purchase agreement. On appeal, the Eastern District of Missouri affirmed the trial court's certification of the judgment as final under Rule 74.01(b) and reversed the dismissal, holding that the forum selection clause was not specific enough to encompass the Appellants' tort claims.
