Supreme Court of Missouri / Jun 4, 2019
State ex rel. AJKJ, Inc., Relator, vs. The Honorable Craig E. Hellmann, Respondent.
AJKJ, Inc. sought a writ of prohibition to prevent the circuit court from exercising jurisdiction in an underlying deed reformation case. The circuit court had vacated its judgment after sustaining motions to intervene and set aside filed by non-parties, more than 30 days after entering final judgment. The Supreme Court of Missouri made its preliminary writ of prohibition permanent, holding that the circuit court lost jurisdiction 30 days after entering final judgment because motions filed by non-parties are not "authorized after-trial motions" that extend jurisdiction under Rule 81.05. Therefore, the circuit court's subsequent rulings on the motions were void.
