Missouri Court of Appeals, Eastern District / Sep 25, 2018
Stephanie Fisher, Employee/Respondent, v. Ste. Genevieve County Health Department, Employer/Appellant, and Division of Employment Security, Respondent.
Stephanie Fisher was discharged from her administrative clerk position at Ste. Genevieve County Health Department after a verbal altercation with her supervisor regarding a leave request. She applied for unemployment benefits, which the Appeals Tribunal denied based on misconduct. The Labor and Industrial Relations Commission reversed, awarding benefits to Fisher. The appellate court affirmed the Commission's decision, holding that while the employee's conduct might warrant termination, it did not meet the statutory definition of "misconduct connected with work" to disqualify her from unemployment benefits.
