Stephen Gregory Perry was found guilty of first-degree statutory sodomy and sentenced to life in prison. In a prior appeal, his conviction was upheld, but his life sentence was vacated because he was erroneously sentenced as a predatory sexual offender. Upon remand, the circuit court again imposed a life sentence. In this appeal, Perry claimed the life sentence was grossly disproportionate and violated his constitutional rights. The appellate court declined plain-error review and affirmed the judgment, finding no facial manifest injustice as the sentence was within the statutory range.
