Steven W. Marrs was convicted by a jury of driving while intoxicated (DWI) and subsequently found by the circuit court to be a habitual DWI offender, enhancing his offense to a class-B felony. On appeal, Marrs challenged the habitual offender finding, arguing insufficient evidence for one of the alleged prior intoxication-related traffic offenses (IRTOs) from Utah. The appellate court affirmed the circuit court's judgment, concluding that even if the Utah conviction was excluded, the State's unchallenged evidence of other IRTOs was sufficient to support the habitual offender finding, and the circuit court was not required to specify which convictions it relied upon.
