State of Missouri vs. Teddy Charles Hammer
Teddy Hammer was charged with sexual misconduct involving a child and entered into a deferred prosecution agreement. This agreement included an admission of guilt and a waiver of certain defenses, such as mental disease or defect or diminished capacity, if he failed to comply with its terms. After the State refiled charges due to Hammer's non-compliance, a jury found him guilty. On appeal, Hammer contended the trial court erred by enforcing the agreement and precluding evidence of his diminished capacity. The appellate court affirmed, concluding that the waiver in the deferred prosecution agreement was knowing, voluntary, and intelligent.
