Thomas A. Stricklin was convicted of first-degree statutory sodomy, and on appeal, challenged the admission of incriminating statements made during a police interview. He argued the interview became a custodial interrogation, violating his Miranda rights, as he was never Mirandized despite repeatedly requesting a lawyer. The appellate court reversed and remanded for a new trial, holding that the interview became custodial when an officer told Stricklin he would be "going in cuffs" if he didn't "settle this up," and therefore, the statements made after that point should have been suppressed.
