Missouri Court of Appeals, Southern District / Jun 12, 2019
DAVID A. JUNGERS and LEISA JUNGERS, husband and wife, Individually and as Trustees of the DAVID A. JUNGERS TRUST, Dated May 15, 2001, Plaintiffs-Appellants vs. WEBSTER ELECTRIC COOPERATIVE, INC., a Missouri Corporation, Defendant-Respondent
David and Leisa Jungers sued Webster Electric Cooperative for damages after negligent transformer installation caused water damage to their home. Webster paid for the repairs, but the Jungers sought additional damages for the lost sale of their home and diminution of its value. The trial court granted summary judgment for Webster, ruling that damages were limited to the cost of repair. The appellate court affirmed, holding that the cost of repair was the proper measure of damages given the successful repairs, and that the claimed lost sale damages were merely an alternative form of diminution of value, which was not recoverable.
