Ace A. Carpenter and Sandra Carpenter vs. Kathleen r. Carpenter
Ace and Sandra Carpenter (the Carpenters) appealed a trial court judgment granting their petition for partition of property and ordering its sale, but challenged the distribution of proceeds which awarded Kathleen Carpenter (Kathleen) the first $496,000 as reimbursement. The Carpenters contended there was no substantial evidence to support this award. The appellate court affirmed the reimbursement for the lot purchase, warehouse construction, and warehouse addition, finding substantial evidence. However, it reversed and remanded the portion of the judgment awarding Kathleen $185,000 for miscellaneous repairs and improvements, concluding that this finding lacked substantial evidence.
