The Trustees of Riverwood Estates Homeowners Association appealed from a judgment in favor of Ada Taylor, a homeowner, regarding her trash enclosure, alleged failure to seek approval, and delinquent assessments. The appellate court affirmed the trial court's finding that the trash enclosure did not violate the subdivision's declarations and that the Trustees had waived their right to object. However, the court reversed the trial court's judgment regarding delinquent assessments, finding that the homeowner had judicially admitted owing them. The court also affirmed the trial court's admission of photographic evidence.
