Alejandro Flores-Martinez was convicted of first-degree sexual abuse following a bench trial. On appeal, he challenged the trial court's decision to allow an amendment to the charging document and the sufficiency of the evidence. The appellate court rejected both of Defendant's claims but sua sponte reversed the judgment and remanded for a new trial because the trial court failed to obtain a valid waiver of Defendant's right to a jury trial.
