Clifton Jameson, Appellant, vs. Alexis Still, Respondent.
Clifton Jameson sued Alexis Still for damages after an automobile accident. Jameson offered to settle with Still's insurer, MetLife, under sections 408.040 and 537.058, but MetLife responded with a counteroffer. Jameson then sued, and MetLife subsequently attempted to accept the original offer. The circuit court granted summary judgment for Still, finding a settlement agreement had been reached. The Supreme Court of Missouri vacated the summary judgment and remanded, holding that MetLife's counteroffer terminated Jameson's original settlement offer under common law contract principles, which were not altered by the referenced statutes.
