Amanda Lee Baker appealed the denial of her Rule 24.035 motion for post-conviction relief without an evidentiary hearing, which alleged ineffective assistance of plea counsel. The appellate court reversed and remanded the case. It found that Baker's amended motion was untimely filed because the motion court never ruled on her request for an extension. The court further held that the motion court erred by not conducting an independent inquiry into whether post-conviction counsel abandoned her, as required by precedent.
