Consumers sued Dealers under the Missouri Merchandising Practices Act after their vehicles were stolen or damaged. Dealers moved to compel arbitration, which the circuit court partially denied, compelling arbitration for some consumers but not others. The appellate court vacated the circuit court's order, holding that the arbitration agreements were enforceable and delegated the determination of arbitrability to an arbitrator. The case was remanded with instructions to compel arbitration for all consumers.
