State of Missouri vs. Antwan T. Crosby
Antwan T. Crosby appealed his conviction and sentence for second-degree kidnapping, arguing the trial court erred by denying his motion to dismiss based on Interstate Agreement on Detainers (IAD) time limits and by finding him a persistent offender. The appellate court affirmed Crosby's conviction, finding no IAD violation as the 180-day limit applied and was met. However, the court reversed the persistent offender finding and remanded for resentencing, concluding that prior felony findings entered after the current offense's commission could not be used to establish persistent offender status, resulting in a sentence exceeding the legal maximum.
