Missouri Court of Appeals, Eastern District / Oct 13, 2020
Arthur R. Piva, Appellant, vs. Richard A. Piva, Respondent.
Arthur Piva sued his brother, Richard Piva, for invasion of privacy after Richard published a book. A default judgment was entered against Richard, which the trial court later set aside pursuant to Rule 74.05(d). Arthur appealed, arguing the trial court abused its discretion by considering defective motions and affidavits, and by finding good cause and reasonable filing time. The appellate court affirmed the trial court's decision, finding no abuse of discretion.
