Missouri Court of Appeals, Southern District / Nov 19, 2024
In the Interest of: A.S., WEBSTER COUNTY JUVENILE OFFICE, Petitioner-Respondent v. A.S., Respondent-Appellant
This appeal challenged a juvenile court's judgment dismissing a delinquency petition against a fifteen-year-old female, A.S., and transferring her to a court of general jurisdiction for prosecution on felony charges of first-degree murder and armed criminal action. A.S. argued the juvenile court abused its discretion by improperly relying on the range of adult punishment. The appellate court affirmed the judgment, finding no abuse of discretion because the adult punishment range is logically relevant to the seriousness of the offense and the juvenile court is not limited to the statutory factors in its certification decision.
