Assurance General Contracting, LLC (AGC) sued HK Internal Medicine Associates, LLC (HK) for breach of contract related to roof repairs, and HK counterclaimed. A jury found in favor of HK, but the trial court awarded AGC prejudgment interest. On appeal, AGC challenged the trial court's denial of its Batson challenge and the exclusion of lost profits evidence. HK cross-appealed the prejudgment interest award. The appellate court affirmed the trial court's rulings on the Batson challenge and lost profits, but reversed the award of prejudgment interest to AGC.
