Barry Edward George was convicted of DWI and trespass. At trial, he and his counsel repeatedly admitted his intoxication and drunk driving, relying on a justification defense. On appeal, George claimed plain error because a police officer testified to the 0.08 "legal limit" for DWI. The appellate court affirmed the conviction, holding that George's own voluntary judicial admissions rendered the officer's testimony irrelevant and harmless.
