Behavioral Science Institute, Inc. sued Transitional Center, Inc. for breach of contract, obtaining a default judgment. The circuit court later granted Transitional Center's motion to set aside the default judgment. On appeal, the Eastern District reversed the circuit court's decision, holding that Transitional Center failed to present sufficient evidence to establish good cause for its failure to respond to the petition, as required by Rule 74.05(d).
