Billy Ray Littlefield appealed his conviction for attempted robbery in the first degree, arguing there was insufficient evidence of the use of physical force to overcome an officer and retain stolen goods. Littlefield had taken a flashlight from Walmart and resisted arrest, yelling "Shoot this fool" while his armed brother was nearby. The appellate court affirmed the conviction, finding that Littlefield's physical resistance combined with his statement and knowledge of his brother's armed presence constituted sufficient evidence of forcible stealing.
