Black River Motel, LLC, et al. Missouri Cases

Patriots Bank sought the appointment of a receiver for Black River Motel, LLC, et al., due to loan defaults. The circuit court appointed a receiver, and Appellants' subsequent motion to vacate the order was overruled. On appeal, Appellants argued that the Missouri Commercial Receivership Act (MCRA) as applied violated due process, that Bank failed to comply with notice requirements, and that the circuit court abused its discretion. The Missouri Supreme Court affirmed, holding that the MCRA provided adequate due process, Bank complied with notice, and the circuit court did not abuse its discretion in appointing the receiver or in its order.
