Robert S. Whitmore, as trustee for Nancy Billow, sued BLH Development Company, LLC, Tri-Lakes Escrow, Inc., and Branson Landing Hotel, LLC, seeking the return of an escrow deposit for a condominium purchase. The claims included violations of the Missouri Merchandising Practices Act and fraudulent transfer. The trial court found in favor of all defendants. On appeal, the Missouri Court of Appeals, Southern District, affirmed the trial court's judgment, finding no error in the trial court's procedural rulings and its determination that the appellant failed to properly raise or preserve various claims.
