Missouri Court of Appeals, Eastern District / Apr 14, 2020
State of Missouri, Respondent, v. Brian K. Garrett, Jr., Appellant.
Brian K. Garrett appealed his convictions for three counts of second-degree assault, three counts of armed criminal action, and other firearm offenses, stemming from firing a single shot at a vehicle containing three passengers. He challenged the sufficiency of the evidence for multiple assault counts and alleged errors in the verdict form and the written judgment. The appellate court affirmed the convictions, finding sufficient evidence for all counts and no manifest injustice from the verdict form error. However, the court modified the trial court's judgment to correct a clerical error that incorrectly listed the assault convictions as first-degree instead of second-degree.
