Missouri Court of Appeals, Eastern District / Jul 16, 2024
State of Missouri, Respondent, vs. Brian Keith Heathcock, Appellant.
Brian Keith Heathcock appealed his Warren County conviction for first-degree tampering with a motor vehicle, arguing it violated his double jeopardy rights because he had already pled guilty to tampering with the same vehicle on the same date in Montgomery County. The Eastern District of the Missouri Court of Appeals reversed the tampering conviction and vacated its sentence. The court held that the successive prosecutions for unlawfully operating the same vehicle constituted multiple punishments for the same offense, violating the Double Jeopardy Clause, and that the State failed to prove a separate tampering offense in Warren County due to a lack of independent corroborating evidence. His convictions for resisting arrest and attempted victim tampering were affirmed as unchallenged.
