Brian Graves appealed his conviction for two counts of felony abuse of a child, arguing the trial court erred by denying his motion for a mistrial and by refusing to provide an advisory opinion on an expert's report. Graves was convicted after his 8-week-old infant sustained numerous fractures and he confessed to shaking the baby. The appellate court affirmed the judgment, finding no abuse of discretion by the trial court on either point.
