Brook Chateau Missouri Cases

Theron Ingram, a quadriplegic, was admitted to Brook Chateau, a residential care facility, where his agent, Andrea Nicole Hall, signed a voluntary arbitration agreement on his behalf using a Durable Power of Attorney (DPOA). Ingram later sued Brook Chateau for negligence, and Brook Chateau moved to compel arbitration. The circuit court overruled the motion, and the court of appeals affirmed. The Supreme Court of Missouri reversed, holding that the DPOA's grant of "full authority" to move Ingram into a facility included the incidental authority to sign the arbitration agreement, even if voluntary.
